The Contest Mechanics and Eligibility

• The Sourire Pour Moi Contest (“Contest”) shall be held from 12 th January 2008 at 0000hrs to 28 th March 2008 at 2359hrs(“Contest Period”) and will close at the end of the Contest Period or such other time that Astro shall decide from time to time. Entries received after the stipulated time will be ineligible for the prize.

• Wherever applicable, the Contest Block during the Contest Period shall be as follows or such other time that Astro shall decide from time to time:

• The Contest is open to subscribers of prepaid and post-paid services of Maxis, DiGi and Celcom providing Short Messaging System (“SMS”) services in Malaysia and where applicable users of Telekom Malaysia fixed line (“Contestants”).

• To enter the Contest, the Contestant must request for Chinese question by keying in SPC to 33888 and answer the question by sending it to Astro by keying in SPC<space><A/B> to 33888. The Contestant can request for English question by keying in SPE to 33888 and answer the question by sending it to Astro by keying in SPE<space><A/B> to 33888. (“Contest Entries”).

• The Contestant can send in as many Contest entries as they wish.

• Contestants will be charged a premium charge of RM1.00.

• During the Contest Period, Contestants will be prompted to participate in the Contest via on-air promos, press advertisements, promotional sms messages and the Astromobile website.

Selection of Winners

• Contest winners will be chosen based on the mobile number with the most correct answer in a set of 3 questions in the fastest time .

• There will be oneGrand Prize winner entitled to the following prize every week;

Standard Terms and Conditions

• Charges

• Each Contest entry sent by the Contestant will be subject to a premium charge as stipulated. This charge is in addition to the standard fee charged by the Contestant’s respective telecommunications service provider.

• Contest Entries

• The Contestant must ensure that their Contest entries are complete and accurate. I ncomplete, illegible or late entries shall be disqualified.

• Astro reserves the right to reject any registration and/or entry at its sole and absolute discretion without having to assign any reasons whatsoever.

• All Contest entries must be submitted in the language specified. Contest entries in any other languages will be rejected by Astro.

• Employees of ASTRO ALL ASIA NETWORKS plc (“Astro”) including its subsidiaries and affiliates, sponsors, agencies, dealers, retailers and their immediate family members are not eligible to participate in this Contest .

• Contestants under the age of eighteen (18) must seek parental and/or guardian approval before participating in the Contest. Astro considers it the responsibility of parents and/or guardian to monitor their children’s participation in this Contest.

• Where applicable, Contestants must obtain consent from the bill payers before participating in the Contest. Payment shall be made irrespective of whether such charges were authorised by the bill payer. For the purposes herein the term "bill payer" shall mean the individual, company or entity specified in the registration or subscription form whose application for the relevant service has been approved and accepted by the service provider.

Judging

• The Judge’s decision is final and binding. No correspondence shall be entertained.

Notification of Contest Winners

• Contest winners will be notified by telephone call to his/ her mobile phone for which the contact number shall be the number used by the Contestant for submission of the answers. Notwithstanding the foregoing, Astro reserves the right to use any other method or medium Astro deems fit at its sole and absolute discretion for the purpose of announcing the Contest winners.

• Upon request, Contest winners will be required to give their contact details, I.C. No., Astro account number and any other details deemed necessary and relevant by Astro at its discretion within the time period specified or upon receiving the request/notification from Astro .

• Proof of mailing, faxing, or delivering (in any manner whatsoever) any details to Astro does not denote proof that Astro has received such details

• Astro reserves the right to forfeit prizes for any Contest winner who does not provide the required details upon receiving the request/notification from Astro .

• Astro reserves the right to appoint a third party to conduct the verification of Contest winners and to fulfil the delivery of prizes and Contestants agree that Astro may provide all necessary information of Contest winners to such third party to facilitate such service.

Contest Prizes

• Astro reserves the right to change the prizes without any prior notification.

• The Contest winner shall be responsible for all costs in connection with perfecting his/her prize, including but not limited to legal cost, stamp duties, registration and transfer fees, taxes, insurance, spending money and related expenses (such as meals or personal expenses, upgrades etc.) or fees.

• Where applicable, cash prizes shall be issued to the winners in the form of a cheque. Cash prize winners will be responsible for all related banking charges (including outstation cheque charges) imposed by banks in clearing his/her cheque.

• Each Contest winner shall be entitled to one (1) prize only.

• Contestant will not be eligible/entitled to win prizes if the Contestant has won any prize(s) of value between RM400 – RM4000 in any Contest organised by Astro in the past thirty (30) days prior to entering the Contest;

• Prizes not claimed within the time period specified or upon request/notification from Astro shall be forfeited. Prizes are not exchangeable, transferable or redeemable in any other form for whatever reason. Contest winners are solely responsible for the collection of their prize and Astro and its agents, sponsors and representatives shall have no liability to the Contest winners in any respect whatsoever.

• Prizes are non-transferable and there is no cash alternative.

• Astro reserves the right to request written proof of residency and of the age of any Contest winner before the prize is dispatched or collected.

• Astro makes no warranties or representations whatsoever with respect to the prize and shall not be responsible nor liable for any problems and/or damage thereto or arising therefrom.

• Prizes must be claimed in person unless Astro advises otherwise. Identification which includes a photograph will be required (examples include identification card/drivers licence/passport which displays a photograph of the Contest winner). Where Astro elects to post a prize to a Contest winner no responsibility will be accepted by Astro for the safe and effective postal delivery of the prize.

• In special situations, and subject to the absolute discretion of Astro, a Contest winner may nominate a designated representative to collect a prize. The representative will be required to present written authorisation from the Contest winner and identification which includes a photograph for both the Contest winner and their representative.

• In the event that a Contest winner chooses not to accept a prize, they forfeit any and all claims to that prize, which will be dealt with according to the absolute discretion of Astro.

• The Contest winner(s) of any prize(s) may at the absolute discretion of Astro be required to execute a deed of release and indemnity in a form prescribed by Astro in order to receive the prize.

• All prizes are accepted entirely at the risk of the Contest winner, and Astro excludes all warranties in connection with any prize to the extent permitted by law. Contest winners shall comply with the terms and conditions of each prize.

• Travel Prizes (where applicable)
• Unless otherwise specified, the class of travel for any travel prize incorporating an airfare is econo my class.
• Travel prizes must be taken within the time period in accordance with the dates and destinations and number of passengers specified by Astro, its agencies, sponsors and representatives or will be deemed invalid. There will be no cash alternative. There will be no alternative destination.
• Travel prizes are non-transferable and are subject to availability. Travel prize winner must hold a valid passport with at least six (6) months' further duration (or competition entry will be invalid).
• Any travel by minors shall be in accordance with the terms and conditions of the respective carrier and where specified accompanied by the parent(s) or legal guardian.
• In the event of unforeseen circumstances or circumstances outside Astro's reasonable control Astro reserves the right to offer an alternative prize of equal value. No cash will be offered.
• Travel prize winner shall comply with the terms and limitations of any insurance policy relating to the travel prize.
• Travel prize winner shall comply with the terms and conditions of the airline and other transportation and venues involved in the Contest or the travel prize. In particular, the travel prize winner shall comply with all health and safety guidelines and instructions and all applicable legal and regulatory requirements and are responsible for attending to any inoculation and health regulations required for their destination.
• Travel prize winners are not entitled nor authorised in any way to commit Astro, its agencies, sponsors and representatives to any contract, expense or cost entered into or incurred. No variation of these Contest Terms and Conditions is effective unless approved by an authorised representative of Astro in writing
• It shall be the responsibility of winners to obtain the necessary visa and other travel documents at their sole cost and expense. Passport control and in-country authorities will reserve the right to refuse entry. If the winner of a travel prize is refused passage and or entry/exit to or from the country being visited, any additional costs incurred will be at the sole cost and responsibility of the travel prize winner and no compensation whatsoever will be given should the travel prize winner, regardless of the circumstances.
• Any flights, other transport, airport details, accommodation or other aspects of the travel prize, dates and times quoted by Astro, its agencies, sponsors or representatives are for guidance only and are subject to change without notice with no liability arising against Astro, its agencies, sponsors or representative.
• Travel prize winner must have sufficient financial resources to meet any financial commitment which they may incur in connection with the travel prize beyond those included in the travel prize itself (including, without limitation, transfers to and from any airport specified in the travel prize, meals and drinks, room services, laundry, excess baggage, personal, medical and/or baggage insurance, all items of personal nature, custom tax and airport tax.).

Proof of Receipt

• Proof of SMS sent by a Contestant does not denote proof that the SMS was received by Astro.

Prize Giving Ceremony

• In the event Astro has a prize giving ceremony, the Contest winner(s) are required to attend at his/her own cost and expense to collect the prize. In the event the Contest winner is not able to attend the prize giving ceremony, the Contest winner must nominate a representative to be present at the prize giving ceremony to accept the prize on his/her behalf.

Publicity

• Astro reserves the right, at its sole and absolute discretion, to use the nicknames, names, photographs, voice or video recordings and entries of the Contest winner(s) and/or representatives without first obtaining any consent nor making any payment whatsoever to the Contest winner(s) and/or representatives for publicity, advertising, trade or promotion purposes in any media.

Use of Mobile Numbers

• Astro and/or its affiliates reserve the right to send SMS messages to the Contestants mobile phone numbers containing information and promotional activities regarding a ny other Astro promotions .

• If a Contestant does not wish to receive such SMS messages the Contestant is required to call and inform Astro accordingly by calling Astro’s call centre at 1 300-82-3838.

Adherence to Contest Terms & Conditions

• All Contestants shall be required to adhere to the Contest Terms and Conditions and the Astro Website Terms of Use and Notices including any changes made thereto. Astro reserves the right to forfeit the prize(s) in the event any of the Contest Terms and Conditions and/or the Astro Website Terms of Use and Notices are not adhered to.

Variation to the Terms & Conditions

• Astro reserves the right to change, amend, delete or add to these Contest Terms and Conditions without prior notice at any time and the Contestants shall be bound to such changes.

Liability

• Astro will not be responsible or liable for:

• any problem, loss or damage of whatsoever nature suffered by any party due to any delay and/or failure in receiving and sending a SMS as a result of any network, communication or system error, interruption and/or failure experienced by the participating telecommunication service provider and/or by Astro and/or resulting from participation or the downloading of any materials in the Contest. In the event of such error, interruption and/or failure, Astro shall not be responsible or liable for any failure by any Contestant to participate in the Contest at any time.

• any problem, damage or loss of whatsoever nature to any Contestant, or their authorised representatives resulting from their participation in the Contest.

• any error (including error in notification of Contest winners), omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorized access to entries, or entries lost or delayed whether or not arising during operation or transmission as a result of server functions, virus, bugs or other causes outside its control.

Disqualification

• Astro reserves the right at its sole discretion to disqualify any individual that it determines to be tampering with the entry process or the operation of the Contest, to be acting in breach or potential breach of these Contest Terms and Conditions and/or the Astro Website Terms of Use and Notices. No correspondence shall be entertained.

Suspension  

• Astro further reserves the right to cancel, modify, suspend or delay the Contest for any reason whatsoever.
